1 BACKGROUND INFORMATION

1.1 Beneficiary
The Customs Service of Ukraine (UA SCS) and the State Border Guard Service of Ukraine (UA SBGS)

1.2 Contracting Authority
United Nations Development Programme (UNDP)

1.3 Relevant country background
The Moldova-Ukraine State Border is 1,222 km long, consisting of 955 km of green border and 267 km of blue border. There are 67 official border crossing points along the Ukraine border, including international, inter-state and local ones. At the Moldova-Ukraine border, a section of 472 km is under control of the so-called Transnistrian authorities, including 25 official crossing points (5 international, 8 inter-state and 12 local). There is an internal / administrative “boundary” between the so-called Transnistria and Moldova proper (which is basically the Dniestr River) where 14 Internal Customs Control Posts have been established. Moldovan border guards do not control this “internal boundary”.
In June 2005 the Presidents of Moldova and Ukraine sent a joint letter to the EU requesting assistance for enhanced border management capacities, including the development of an international standard of border and customs control at the Moldova/Ukraine state border. The EU responded positively to this request and an EU Border Assistance Mission to Moldova and Ukraine was set-up which is based on a Memorandum of Understanding dated 7 October 2005 and signed between the European Commission, the Republic of Moldova and Ukraine. The initial duration of the EUBAM was 2 years. Its mandate has been extended for further 2 years until end of November 2009. UNDP is the European Commission’s implementing partner in this endeavor.

EUBAM’s mandate is, amongst others, helping to enhance the capacities of Moldovan and Ukrainian services to adequately ensure customs and border controls and border surveillance along their common border. The project proposal comes from the identification of the need to improve procedures and skills in relation to utilising risk based, intelligence led approaches in enforcement work. To assist in achieving this EUBAM has procured i2 Analysts Notebook and a suite of enhancements including Pattern Tracer, I-Bridge and other components to enhance the analytical capacities of the Risk Analysis functions in UA SCS and UA SBGS.
The Analytical Software Expert /Trainer will design and deliver training to users of the software (at their place of work at different locations in Ukraine, namely Kiev, Kotovsk, Mogilev Podolsky and Odessa). The training will aim to equip practitioners with the skills needed to make effective use of the analytical software that is being provided.

1.4 Current state of affairs in the relevant sector
i2 analytical software (Analysts Notebook and other elements of the i2 suite) have been provided to the risk analysis departments of UA SBGS & UA SCS. To date no training in the use of these tools has been delivered. There are approximately 45 users in UA SCS and a similar number in UA SBGS.

2. DTRA (Defence Threat Reduction Agency)
Ukraine/Moldova Land Border Project and Ukraine Maritime Proliferation Prevention Project. Implemented by the US Embassy in ukraine, Raytheon company as a private contractor
The overall objective of the project is to enhance the capability of the SBGS and SCS to detect and interdict the illicit trafficking of WMD and related materials through Ukraine’s international and state points of entry (POEs) on the land border and waterways forming parts of the border between Moldova and Ukraine.
Donation and training in use of physical and chemical detection equipment are provided through US Embassy staff in Kyiv and Raytheon company as private contractor. This Project also includes physical surveillance equipment such as mobile radars (land and maritime) and night vision devices. On-going

3. International Organization for Migration (IOM) Ukraine
The IOM’s Mission in Ukraine is to assist the GOU in meeting growing operational challenges of migration management, advancing understanding of migration issues, encouraging social and economic development through migration, and upholding the human dignity and well-being of migrants.
The IOM Mission in Ukraine opened in 1996 and operates four programs: I. Capacity Building in Migration Management — Specific projects relating to the SBGS include:
- Developing Approaches to Implementation of Risk Management and Criminal Analysis Systems in the SBGS.
- Feasibility Study and Terms of Reference on the Possibilities for an Enhanced Cross-Border Information Exchange System at the Ukrainian-Moldova State Border.
- Reinforcing the SBGS’s Human Resources Management System. II.
- Counter-trafficking in Human Beings,
III. Migration Health, and Migration Movement and
IV. Labour Migration.

4. HUREMAS (Human Resources Management) Programme, IOM in Ukraine
This involves the use of international advisors (initially from Poland and Hungary) dealing with legal reforms and humanitarian issues respectively).The main aim is to develop professional managerial skills in personnel issues but it may have wider implications On-going

5. EXBS Program (Export Control and Related Border Security Program). Implemented by the U.S. Department of State (DOS)
The EXBS program comprises a wide range of nonproliferation export control assistance, from licensing and legal/regulatory technical workshops, to provision of nonproliferation equipment and training for border control and enforcement agencies, such as the SCS, SBGS, the State Service for Export Control of Ukraine, and the State Ecological Inspection of Ukraine.
The EXBS program assistance in Ukraine includes provision of training services, equipment and other commodities related to the detection, deterrence, monitoring, interdiction, and prevention or countering of proliferation. (Equipment provided includes, but is not limited to, different border inspectional tools, large scale x-ray equipment to be used at rail/sea corridors etc.)
The EXBS program in Ukraine has already scheduled Targeting and Risk Management course designed for customs inspectors to assist them to understand risk management process. that includes: collection of data and information; analysis and assessment of risk; development of an effective action plan and skills to track and report findings, with the knowledge, skills and abilities to better screen shipments by identifying those that present a risk and targeting those that should be inspected.

6. Assistance in Reforming and Increasing the Efficiency of the State Border Guard Service of Ukraine. Implemented by the OSCE
The overall goal of this project is to assist, on the request of the government of Ukraine, the Ukrainian State Border Guard Service (USBGS) to strengthen the border security at the South-West border section, selected by the SBGSU, by providing this law-enforcement agency with:
1) IT equipment; and 2) capacity building training in risk analysis to border police officers.
This project, which has a pilot character for the SBGSU, will result in the improved operational and professional capacities of the USBGS to collect and analyze data on illegal cross-border activities at the South-West border of Ukraine. Starting Date: May 1, 2006, ending Date: May 1, 2007

7. ICITAP (U.S. Department of Justice, International Criminal Investigations Training and Assistance Program), implemented by the US Embassy in Moldova

2 OBJECTIVE, PURPOSE & EXPECTED RESULTS

2.1 Overall objective
The Analytical Software Expert /Trainer will deliver a training course and follow up tutoring in Analysts Notebook and related tools to practitioners from UA SCS and UA SBGS.

2.2 Specific objectives
Specific objectives of this contract are as follows:

• To devise a short course (approximately 5 working days) to be held at the place of work of the users or at a suitable training facility of UA SCS and UA SBGS in Analysts Notebook and related tools. The training should feature the theoretical base as well as practical exercises and should be reinforced by mentored audit visits to businesses.
• To train up to 20 customs and up to 25 border guard officers in total. The trainees will, once trained, act as a resource and point of contact where officers can seek and get advice and help on Analysts Notebook and related tools.
• To devise and deliver training materials to accompany the training.
• To collaborate with the staff of the risk analysis units and training units of UA SCS and UA SBGS and share all training material with them.
• To prepare resource materials to equip the trainees.

2.3 Results to be achieved by the Consultant

The Consultant will:
1 Deliver three 5-days training course for Ukrainian border guards and 5 days training course for Ukrainian customs officers deployed at the borders of Moldova and Ukraine, Regional offices and inland clearance depots in Analysts Notebook and related tools.
2 Produce course notes, course materials and practical exercises that will be part of the training and will be available for use in future training events by the training units of UA SCS and UA SBGS
3 Prepare capable officers in the risk analysis units of both services
4 Produce a report that includes an evaluation of the training and recommendations for future work needed.

3 ASSUMPTIONS & RISKS

3.1 Assumptions underlying the project intervention

1. UA SCS and UA SBGS will remain prepared to approximate their services towards EU standards and will provide sufficient logistic support to the consultant.
2. UA SCS and UA SBGS will allow appropriate access to the consultant to premises, systems and personnel.
3. Legal and other regulatory frameworks are in place to support and enable the work in hand.

3.2 Risks

1. Failure to adequately staff and resource the UA SCS and UA SBGS to sustain the use of risk analysis in directing operations;
2. Loss of political support for the implementation of border and customs management reform;
3. Wider institutional weaknesses that impact on the ability to successfully and effectively implement using of i2 systems;
4. Redeployment of newly trained i2 staff to other functions within the beneficiary agencies.

4 SCOPE OF THE WORK

4.1 General

4.1.1 Beneficiaries

4.1.2 Project description

The project can be divided into 3 phases:
1) Planning & Preparation
2) Delivery of the training
3) Post training evaluation

4.2 Specific activities
The phases should be carried out in chronological order.

During the 1st phase the Trainer will prepare and refine the training materials and send them to the EUBAM — these materials will be translated (by EUBAM). Training staff from the Academy will assist and participate during this preparation phase

In the 2nd phase the Trainer will deliver training to up to 45 trainees (training to be delivered in batches) from UA SCS and UA SBGS.

In 3rd phase the work done will be evaluated and recommendations made, including recommendations for further work to be done and further donor assistance that may be required.

4.3 Project management

4.3.1 Responsible body
The United Nations Development Programme (UNDP) will be responsible for managing the contract.

4.3.2 Management structure
On the Contracting Authority’s side, the project will be managed by UNDP.

4.3.3 Facilities to be provided by the Contracting Authority and/or other parties
Contracting Authority: Translation, administrative and logistical support for the consultant.

Beneficiary Agencies: (1) staff to be trained – these staff will be released from their normal duties and enabled to attend the training event; (2) Preparation and training rooms at the chosen training facility.

5 LOGISTICS AND TIMING

5.1 Location
The venue for the training will be provided by UA SCS and UA SBGS in Ukraine – it is likely that the trainer will be required to deliver the training in different locations in Ukraine.

5.2 Commencement date & Period of execution
The projected duration of the consultancy is 28 working days.

i. Commencement date
The intended commencement date is 20 April 2008.

ii. Period of execution
The execution of the contract shall be completed by 30 October 2008.

6 REQUIREMENTS

6.1 Personnel
Key expert: Analytical Software Expert /Trainer

a) General:
• Earlier international exposure, the ability to work independently but also in a multicultural environment is an asset;
• Experience in the design and delivery of training.

b) Qualifications and skills
• Master’s degree in Information Systems, Information Management or Bachelors with four years of experience in Computer Science or related discipline;
• A minimum of 5 years of appropriate experience in a customs or border police (or similar) institution in the EU involved in the analysis of information for the purposes of law enforcement using tools such as analysts notebook;
• Specific experience in matters related to the gathering, analysis and use of information for the purposes of risk management and law enforcement;
• Experience in the design and delivery of training in the use of analytical tools;
• Proficiency in English a pre-condition. Knowledge in Russian is an asset;
• Experience in the region is a considerable asset.

c) General professional experience
• Previous experience in the design and delivery of training;
• Ability to write reports and to draft clear and concise documentation;
• Ability to establish priorities and to plan, coordinate and monitor own work plan.

d) Specific professional experience
• Specific experience in the use of Analysts Notebook and related tools in a law enforcement setting
• Specific experience in training in the use of Analysts Notebook and related tools in a law enforcement setting.

6.2 Office accommodation
EUBAM shall make provision for appropriate office accommodation, with Internet access, for the duration of the project.

6.3 Facilities to be provided by the Consultant
The Consultant has to provide adequate equipment that allows him to fully implement this assignment. This includes, in particular, a personal computer with appropriate software.

6.4 Equipment
No equipment is to be purchased on behalf of the Contracting Authority as part of this service contract or transferred to the Contracting Authority at the end of this contract. Any equipment related to this contract that is to be acquired by the beneficiary country must be purchased by means of a separate supply tender procedure.

6.5 Transport
The Consultant is expected to arrange all of his/her transportation within Ukraine independently. EUBAM, whenever possible, will assist the Consultant in arranging the transport means, however all related expenditure shall be borne by the Consultant.

7 REPORTS

7.1 Reporting requirements
The Consultant shall provide a written report (a “Final Report” within one week of the conclusion of the training event that details participants, course content, a timetable of activities, obstacles and issues identified, and suggestions for further development including the need for further donor assistance.

7.2 Submission and approval of progress reports
The working language of the project shall be English. All reports and formal communications relating to the project shall be in the English language. Translation from English to other languages shall be used where operationally necessary or advantageous, but the English-language originals shall be considered the definitive version.

All reports shall in the first instance be submitted to the Programme Manager designated by the Contracting Authority. The Programme Manager is responsible for approving the project reports.

All reports shall be dated and signed by the Consultant.

All reports shall be submitted to the Programme Manager in electronic form (MS Word format) and in two hard copies.

No report or document (PIR, PFR, PPR etc) should be published or distributed to third parties without the approval of the Contracting Authority.

8 MONITORING AND EVALUATION

8.1 Definition of indicators
At a point no more than three (3) months from deployment the Consultant will have provided a training course for up to forty five staff from the beneficiary agencies in the use of analytical tools (including specialist software tools) for law enforcement and risk analysis purposes together with accompanying training material and Final Report.
